Health and Safety for Small Businesses and Charities: The Essentials

When it comes to workplace safety, small businesses and charities often assume their operations are too minor to require professional health and safety services. However, under UK law, all employers, regardless of size, must ensure a safe working environment. From protecting employees and volunteers to avoiding costly penalties, investing in health and safety services is not just a legal requirement but a smart business move.

Key facts at a glance

  • Employers have a legal duty of care to protect the health, safety and welfare of everyone in the workplace, including employees, contractors and visitors.
  • A written health and safety policy is a legal requirement for organisations with five or more employees. It must be kept up to date and communicated to staff.
  • The most common H&S failures in small businesses are informal risk assessments, untrained staff, and poor record-keeping. All three are fixable.
  • RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations) requires employers to report certain workplace accidents and near misses to the HSE.

Employer Responsibilities for Health and Safety

Small businesses and charities are legally obligated to:

  1. Conduct Risk Assessments: Identify workplace hazards and implement measures to reduce risks.
  2. Provide Health and Safety Training: Educate employees and volunteers about workplace safety procedures and emergency protocols.
  3. Maintain a Safe Workplace: Ensure equipment, facilities, and practices meet required safety standards.
  4. Develop a Written Health and Safety Policy: This is mandatory for organisations with five or more employees.

FAQS

  • Is health and safety legislation the same for small businesses?

Yes. Health and safety law applies to all employers regardless of size. The Health and Safety at Work Act 1974 requires all employers to ensure, so far as reasonably practicable, the health, safety and welfare of their employees. What changes with size is the scale and formality of what is required, not the fundamental obligation.

  • Do I need a written health and safety policy?

If you have five or more employees, you are legally required to have a written health and safety policy and to keep it up to date. If you have fewer than five employees, you are still required to have a policy, but it does not need to be in writing. In practice, having a written policy is good evidence of your approach regardless of size.

  • What is a risk assessment and how often should I do one?

A risk assessment identifies hazards in the workplace and evaluates the likelihood and severity of harm. You are required to carry out a suitable and sufficient risk assessment for all significant hazards. Risk assessments should be reviewed when there is a material change in the workplace, after an incident, or at minimum every year.

  • Can Limelite HR help with health and safety compliance?

Yes. Tom Bradley, our Health and Safety Consultant, supports organisations with risk assessments, health and safety policies, compliance reviews and H&S management systems. Get in touch to find out more.

The people we support, supporting us:

  • We have been working with Lisa for the last 18 months initially with our Senior Management Team and more recently with our line managers. Lisa has been covering a wide range of topics on Leadership, using a healthy mix of theory and real life examples. Lisa’s sessions are always good fun and engaging and she has really helped us develop as a team. Team feedback is always positive.

  • The culture handbook has been a really useful tool to give to new employees to help outline who we are and what to expect when working at Riverside. It’s benefited our business as it streamlines information and gives key points staff must be aware of.

    Riverside Home Care
  • At YMCA Worcestershire, we have been through a period of substantial change and development. As part of this we refreshed our vision, mission and values. We also did some solid work in creating a strategic framework with top line objectives. While we had done some preliminaries on further development of this into measurables, a challenge of capacity issues with a need for more operational focus was emerging. We were keen to get through this bottleneck because we knew the strategic planning and implementation would help to ease the operational challenges.

We were very grateful to get Workforce Planning support for this through consultancy work with Limelite HR who reviewed what we’d done so far, liaised with key staff members and helped us to harness this into a more complete and workable format. This is now enabling us to have a clearer road map in our efforts and a means by which to monitor progress and will, in this respect, enhance our impact for those we serve in our charitable and transformative work. We very much appreciated the timely help with this – thank you to Workforce Planning and Limelite HR!

  • Severn Arts asked Limelite HR for their assistance to create a Culture Book as part of their Workforce Planning support programme, funded through WCC, to assist with the onboarding process for new staff members. We sent over our current Employee Handbook, along with our Tone of Voice policy and information about the organisation, as it was a text-only document and quite laborious to read through.
Limelite HR remodelled it into a useful document with images, photos and highlighted text to match our website, creating a more branded put-together document for us to use. We are starting to roll it out with the new starters that will join us in January.
It’s saved us valuable time and resources and is now a live document that we can amend and update as necessary. It’s also encouraged us to review the information in the Handbook and update relevant sections for which we are now scheduling regular reviews.
