Health and Safety for Small Businesses and Charities: The Essentials

When it comes to workplace safety, small businesses and charities often assume their operations are too minor to require professional health and safety services. However, under UK law, all employers, regardless of size, must ensure a safe working environment. From protecting employees and volunteers to avoiding costly penalties, investing in health and safety services is not just a legal requirement but a smart business move.

Key facts at a glance

  • Employers have a legal duty of care to protect the health, safety and welfare of everyone in the workplace, including employees, contractors and visitors.
  • A written health and safety policy is a legal requirement for organisations with five or more employees. It must be kept up to date and communicated to staff.
  • The most common H&S failures in small businesses are informal risk assessments, untrained staff, and poor record-keeping. All three are fixable.
  • RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations) requires employers to report certain workplace accidents and near misses to the HSE.

Employer Responsibilities for Health and Safety

Small businesses and charities are legally obligated to:

  1. Conduct Risk Assessments: Identify workplace hazards and implement measures to reduce risks.
  2. Provide Health and Safety Training: Educate employees and volunteers about workplace safety procedures and emergency protocols.
  3. Maintain a Safe Workplace: Ensure equipment, facilities, and practices meet required safety standards.
  4. Develop a Written Health and Safety Policy: This is mandatory for organisations with five or more employees.

FAQS

  • Is health and safety legislation the same for small businesses?

Yes. Health and safety law applies to all employers regardless of size. The Health and Safety at Work Act 1974 requires all employers to ensure, so far as reasonably practicable, the health, safety and welfare of their employees. What changes with size is the scale and formality of what is required, not the fundamental obligation.

  • Do I need a written health and safety policy?

If you have five or more employees, you are legally required to have a written health and safety policy and to keep it up to date. If you have fewer than five employees, you are still required to have a policy, but it does not need to be in writing. In practice, having a written policy is good evidence of your approach regardless of size.

  • What is a risk assessment and how often should I do one?

A risk assessment identifies hazards in the workplace and evaluates the likelihood and severity of harm. You are required to carry out a suitable and sufficient risk assessment for all significant hazards. Risk assessments should be reviewed when there is a material change in the workplace, after an incident, or at minimum every year.

  • Can Limelite HR help with health and safety compliance?

Yes. Tom Bradley, our Health and Safety Consultant, supports organisations with risk assessments, health and safety policies, compliance reviews and H&S management systems. Get in touch to find out more.

The people we support, supporting us:

  • The production of our culture guide has been really valuable for Fresh Nous. Our new Culture Book has become a key asset for recruitment, tenders, and most importantly, for bringing our culture to life for our team. It captures who we are and how we work, helping us to attract the right people and build alignment internally.
The HR Professional Consultancy Support has been a huge benefit, bringing expert knowledge into our business to help shape the culture book and make it a quality piece that does the content justice.
We are really grateful to WCC for the support, it has been a catalyst in helping us scale with confidence, while staying true to our values and culture.

  • Helen has been very helpful with our recruitment and has helped me see the importance of pitching our company to potential applicants. We are still recruiting for our skilled positions, but I have tweaked my approach to this, and I think I have seen a change in the response, and I have seen candidates keener to arrange trials with us.
I have more understanding of what we should highlight about the company and now, on initially reaching out to candidates take a moment to talk about the company and why it is nice to work there.

They quickly understood our structure and our challenges. The tailored workforce planning session was practical, engaging, and relevant to our real scenarios.

The tools and templates they created for us have already strengthened our planning and helped us think more strategically about capability, succession, and risk. We left the session more confident, better equipped, and far clearer on the HR actions needed to move the business forward.

I would highly recommend Limelite HR & Learning to any organisation looking to build stronger leadership and a more resilient workforce.
