The distinction between employee and self-employed status has significant legal and financial consequences, including employment rights, tax liability and liability for workplace injuries. If your contracts haven’t been reviewed recently, it’s worth doing.

The Employment Rights Act 2025 introduces changes that directly affect construction businesses, including stronger day one rights for employees, new obligations around flexible working requests and reforms to how dismissals must be handled.   • How do I know if my workers should be employed or self-employed?

    The test goes beyond what it says on the contract. If a worker works regular hours for you, uses your tools and equipment, can’t send a substitute and is integral to your business, there’s a strong argument they should be classified as an employee. Getting this wrong can create significant tax and employment law liability. We can review your current arrangements and advise on the right structure.

  • What happens to my employees if I take on a new contract or lose one?

    If workers transfer along with a contract, TUPE (Transfer of Undertakings Protection of Employment) regulations may apply, which means those employees have legal protections around the transfer. We can advise you on whether TUPE applies to your situation and manage the process if it does.

  • Do I need HR support if I only have a small team?

    Yes, often more so. Smaller teams mean every person matters more, and there’s less buffer when something goes wrong. A disciplinary issue, an unexpected resignation or a difficult absence can have a disproportionate impact on a small construction business. Having proper contracts, policies and a bit of HR support in place costs far less than dealing with a tribunal claim.
